Provider and brands
John Fredy Gaviria Zuluaga currently operates as an independent individual provider. ByMyAtlas and Atlas are commercial brands used to present and deliver services. ByMyAtlas, LLC has been formed in Florida. Its role as a contracting party depends on the applicable service, proposal, or contract and is not automatically assumed for every transaction.

Automatic contracting and checkout remain disabled while required fiscal information is completed and published and the applicable legal, tax and payment-provider reviews are closed.
Portfolio, diagnosis and proposal
Public content explains capabilities and base pricing where applicable, but does not by itself create a contract. For scoped services, the commercial relationship begins only after a proposal is issued, scope, price, schedule and applicable terms are reviewed, and the client accepts electronically or in writing.
Payments with Stripe
When checkout is enabled, payments will be processed through Stripe. Atlas does not treat a screenshot, redirect or browser message as proof of payment: final status depends on Stripe's signed webhook and server-side validation of amount, currency, obligation and checkout session.
For governed projects, the V1 commercial rule is 50% upfront and 50% final, unless the accepted proposal expressly defines a different structure. Work begins after the initial payment is verified, and final delivery remains locked until the final balance and required approvals are verified.
Scope changes
Requests outside the accepted scope require written confirmation, a revised estimate or an additional proposal before work begins. Client dependencies—data, access, decisions or approvals—may pause delivery estimates while they remain outstanding.
Cancellations, refunds and payment reversal
Cancellation or refund requests are evaluated based on actual project progress, work already performed, non-recoverable third-party costs, the accepted proposal and any non-waivable rights that apply. No term limits rights that Colombian law makes mandatory.
Where electronic-payment reversal is legally available, the client may exercise it subject to applicable requirements and deadlines. Atlas may retain evidence of the transaction, proposal, acceptance, deliverables and communications needed to process or respond to the request.
Consumer protection
Non-waivable consumer rights are respected where applicable. For official Colombian consumer-protection information, guidance and channels, visit the Superintendencia de Industria y Comercio (SIC).
Intellectual property and delivery
The proposal defines rights to custom deliverables. Pre-existing Atlas components, reusable frameworks, general know-how, open-source software and third-party materials retain their original ownership or license. Final release requires the approvals and payments defined for the project.
International projects
V1 is structured under Colombian law. Projects with clients in other countries may require additional tax, international data-processing, currency, jurisdiction or commercial terms in the specific proposal.
Changes to these terms
The version accepted by the client applies to its proposal unless a later amendment is expressly accepted. The visible date identifies the current public version.
